Chances of Prevailing at Trial
Win or lose, based on Cook County, Illinois statistics compiled since 2006, second most most populous county in the country and one of the largest unified court systems in the world, chances for either Plaintiff or Defendant of prevailing at jury trial are exactly 50/50. Of course, some cases merit a stronger likelihood of success than others, but statistically speaking, it is a 50/50 chance. This also may mean that both sides, Plaintiffs and Defendants are “getting a fair shake,” as presiding Judge of the Law Division, Judge Maddox said.
It further means that Plaintiffs’ traditional favor of Cook County for large jury awards may be overshadowed by their 50% chance of losing (statistically speaking, of course). This further supports the general notion that no matter who wins or loses, not everyone comes out feeling like a big winner.
